The Midlife Academy (TMA) Terms and Conditions for online, in-person and live courses

Please read the following Terms and Conditions and if you have any questions before agreeing to the Terms and Conditions, please contact The Midlife Academy (TMA) by email on hello@midlife.co.uk.

References in these Terms and Conditions to “The Midlife Academy” or to ‘’TMA’’ “we”, “our” or “us” are in each case references to Midlife Limited. References to “you” or “your” are to you, the participant on a Midlife Academy online or in-person course.

These Terms and Conditions are the exclusive basis for the contract between you and us. No other terms or conditions (whenever and however communicated), nor any amendment or addition to these Terms and Conditions will apply unless agreed by a Director of The Midlife Academy in writing.

Intellectual Property Rights

You understand and agree all of the intellectual property rights on our website and all materials, concepts and information presented during the course, whether orally or in writing, are the property of The Midlife Academy. These works are protected by copyright laws around the world. All such rights are reserved.

You agree:

  • not to reproduce, copy or otherwise duplicate such materials without the express permission of The Midlife Academy.
  • that material presented in courses run by The Midlife Academy is intended solely for use on the course. You acknowledge that while you are welcome to benefit from the materials personally and to express and share those benefits in all aspects of your life, you are not permitted to resell, modify and resell, and/or repackage and resell and /or rename and resell the materials.
  • not to use the materials or any part of them (either reproduced or modified) in connection with any seminar, training programme, therapy, workshop, consulting or other commercial or business activity without the written consent of The Midlife Academy.
Data Protection

We will only use your personal information as set out in our Privacy Policy.

At the end of the course, we will ask you if we may use your contact details (with your consent) to circulate, as a contact list, to your specific Midlife Academy course group. We will also ask for your consent to inform you of further workshops or events in the future and if we can use your anonymised feedback on our website as a testimonial.

Booking Terms for in-person and online courses

Fees/charges. Prices quoted by us are exclusive of accommodation and inclusive of tuition and all course materials. In-person courses have lunch, tea and coffee included in their prices. No reduction in fees will be made for non-participation in any aspect of the course, including meals.
Prices may change from time to time, but our charges will be fixed at the time you purchase a course from TMA website.

Cancellation Policy

We understand that circumstances can change. At any point prior to your course you are welcome to contact us at hello@midlife.co.uk, and the following will apply:

  • Cancellation more or equal to 45 days before the course: 100% refund less an administration fee of £100
  • Cancellation less than 45 days and more than 30 days before the course 50% refund
  • Cancellation 30 days or less: no refund.

In the event that:

  • you do not attend the first course session (1/2 day)
  • you withdraw from the course after the start of the first course session
  • you are asked to leave the course for breaching these Terms and Conditions; or
  • you are otherwise in breach of these Terms and Conditions, then no part of the course fee will be refunded.
Course changes

The Midlife Academy reserves the right at any time to:

  • Change the format, participants, content location and timing or any other aspect of a course
  • Postpone events or any part of those events
  • Cancel an event or any part and will not be liable to you for your damages, costs, losses or expenses of any kind incurred or suffered by you in connection with The Midlife Academy modifying, postponing or cancelling a course or any part.

Events changes may include:

  • Converted from in-person to online
  • In the event that the course is not able to proceed as planned, and is moved to a fully online format, your registration will automatically be transferred to online. If you chose to not attend the online course TMA will not be required to refund any part of the course fee. TMA will not be liable for other personal cancellation fees incurred such as flights, accommodation or transfers.

Course cancellation

In the event of cancellation by TMA or the venue, all payments made to us will be refunded in full. We will not be liable for other personal cancellation fees incurred such as flights, accommodation or transfers.

Course postponed

In the event of postponement by TMA or venue, all registration will be carried over to the revised event date unless a refund is requested. TMA will not be liable for personal cancellation fees incurred such as flights, accommodation or transfers.

Event content

A course’s content and program is accurate as at the time of publication. TMA may make changes to an event as required, however, will use reasonable efforts to provide a program and content of the equivalent standard.

Delegates’ rights and obligations

By purchasing a course online and completing your registration form, you warrant your details as provided are true and correct.

You are expected to behave in a professional and appropriate manner at all courses.

You must comply with all verbal and written directions given by TMA whilst attending or participating on the course.

TMA reserves the right, without any liability, to refuse admission to, or to eject you from an event, in its absolute discretion, including (without limitation), for failure to comply with these conditions or if in the opinion of TMA you represent a security risk, nuisance or annoyance to the running of a course.

Photography and the recording or transmitting of audio or visual material data or information are prohibited at a course with TMA’s prior written consent.

Risk management

It is your responsibility to inform TMA of any dietary intolerances or other requirements you may have, sufficiently in advance to enable the TMA to attempt to accommodate these requirements (or where this is not possible, inform you of such).

You use the venue and all associated facilities at your own risk. Despite anything else in these conditions, TMA accepts no liability to you or any third party for any loss of or damage to any of your equipment, materials or other belongings brought to the venue, whether by fire, theft, accident, injury or otherwise.

An event may include inherently dangerous activities, including the use of specialised equipment. Reasonable assistance will be provided; however attendees are responsible for their own well-being and TMA accepts no liability for any loss, damage or injury incurred in connection with an event.

You use the virtual platform and all associated facilities at your own risk. Despite anything else in these Delegate rights and obligations, TMA accepts no liability to you or any third party for any loss of or damage to any of your equipment, materials or other belongings through the use of the virtual platform.

We make no representations, warranties or guarantees that the virtual platform used for virtual events is or will be free from viruses or other malicious code. You are responsible for taking your own precautions in this respect.

Any liability incurred by TMA in connection with the event will be limited to the refund of the fee paid to TMA.

To the maximum extent permitted by law, the TMA excludes all indirect or consequential liability and all liability for any loss (including indirect or consequential loss), expense, damage, personal injury or death incurred (whether or not arising from negligence) by you in connection with the event.

You release TMA from any action, suits, proceedings, claims, demands, costs and expenses, incurred in connection with our acts, omissions or negligence in connection with these conditions or any event. You further indemnify the TMA its employees, agents, contractors and sub-contractors against, and agree to make good, any action, suits, proceedings, claims, demands, costs and expenses (including legal costs, professional costs and other expenses on a full indemnity basis), incurred in connection with these conditions. Any such amount is a debt due and payable within 30 business days of request.

General

TMA reserves the right to amend these conditions from time to time. Unless notified to you, the terms governing your attendance at an event will be those in force at the time of your registration for that event or attendance if you do not need to register (as applicable).

The failure, delay, relaxation or indulgence on the part of TMA in exercising, in part or whole, any power, right or remedy conferred upon that party by these conditions does not operate as a waiver of that power, right or remedy.

If any provision of these conditions is invalid or not enforceable by a court of competent jurisdiction, the relevant term is to be read down and shall otherwise be capable of being severed to the extent of the invalidity or unenforceability without affecting the remaining provisions of these conditions.

These conditions are governed by the laws in the UK.

Insurance

Registration fees do not include insurance of any kind. It is strongly recommended that at the time you register for the conference and book your travel that you take out an insurance policy of your choice. The policy should include loss of fees/deposit through cancellation of your participation in the conference, or through cancellation of the conference, loss of international/domestic airfares through cancellation for any reason, loss of monies through cancellation for any reason including airline or related service strikes within the UK, failure to utilise tours or pre-booked arrangements due to airline delay, Force Majeure or any other reason, medical expenses (including sickness and accident cover), loss or damage to personal property, additional expenses and repatriation should travel arrangements have to be altered. The Conference Organisers cannot take any responsibility for any participant failing to arrange their own insurance. This insurance is to be purchased in your country of origin.

Intention to photograph/record

By registering to attend this event you grant the TMA permission to photograph/video record you during this activity to support promotion, publicity and reporting of this event, and future TMA activities. If you have any objection to being photographed or filmed, please speak to the TMA representative at this event.

Privacy statement

Protecting your privacy and your personal information is an important aspect of the way the TMA conducts its activities, online and offline. By registering to attend this event you are acknowledging that you have read and understood the TMA Privacy Policy which sets out how we collect, use, manage and store your personal information.
